Abstract

In 2010 the States parties of MERCOSUR, except Venezuela, signed the Guaraní Aquifer Agreement Framework, under the Treaty of the Cuenca del Plata´s
provisions. The Guaraní aquifer is the most extended aquifer in the world and contain water in such quantities to supply the entire population of the four countries. Its particularity consists in being a transboundary aquifer. The main objective of the agreement is to rule the management and use of the resource; despite is not entered into force yet has settled the principles to its full application. The most important issue is the engagement assumed by
States to communicate any activity into its borders susceptible to affect its interests, then, began a period of time to reach a solution based in the good faith and cooperation principles. Unluckily, the agreement has not been ratified by Argentina and Brazil and lack a jurisdictional mechanism of disputes settlement.
