Abstract

From an eminently practical perspective, this article analyzes the precautionary solution given by the Constitutional Court in relation to the tourist complex of the “Isla de Valdecañas” which, suffering from total demolition by final ruling, currently appealed for protection, currently lacks effectiveness practice after
more than fifteen years of jurisdictional conflict. After elaborating on the specific case, the focus is placed on the difficulty that the urban planning execution of demolitions continues to cause, particulary when general high-risk interest are compromised (urban planning and the enviroment) and emphasizing that this can not prevent the general jurisdiccional rule of “no suspensión”, except, and in the context of the case analyzed, the possible constitutional precautionary suspensión of the execution of the sentence appealed in amparo. Finally, it is questioned, in general terms, whether urban planning
procedures that are so long in time that allow the construction to materialize, obey the effective judicial protection and the procedure without undue delays that our Constitution guarantees, and this regardless of the different jurisdictional conflicts that a same proceder may arise.
