A LEXITIMACIÓN PARA SOLICITAR O CONCURSO DAS COOPERATIVAS

Abstract

In national and autonomous community cooperatives we are faced with the problem of establishing the standing to file for insolvency proceedings because the Insolvency Law does not specifically refer to cooperatives and, therefore, regard must be had to national and autonomous community legislation for cooperatives. The article focuses on cooperatives as applicants for insolvency proceedings and their members as the parties instituting the insolvency proceeding for their cooperative.
