Abstract

In our working paper we propose to approach the possible correlation existing between the portuguese Private Institutions of Social Solidarity and the public procurement in Portugal taking into account the applicable legislation, some jurisprudence and some Law Compared, as well as doctrinal positions on, not neglecting our own positions that we assume on the topic in question, considering yet yhose we consider to be the main perplexities on the theme presented, pointing here and there, some criticisms that we believe they are constructive in nature, as contemplated in their Legal Status, we think the Portuguese legislator has been a little misguided with regard to classification of the Private Institutions of Social Solidarity accordance with the provisions of the a) to e) aligns of the number 1 of the 2.º article of the Legal Status of the Private Institutions of Social Solidarity.
