TO BE (A MEMBER OF A COOPERATIVE) OR NOT TO BE: THIS IS THE QUESTION! A COMMENTARY ON THE COURT OF APPEAL OF COIMBRA. DECISION OF THE 10 TH OF SEPTEMBER OF 2013

Abstract

In its decision dated of the 10th September 2013, the Tribunal da Relação de Coimbra had to decide about a case in which someone who considered himself a member of a cooperative went to Court because he didn’t agree with what has been deliberated by the cooperative members. Curiously, the deliberation refused him the quality of a member of that cooperative. The Court decided that the deliberation wasn’t nule and void and that the time limit to go to Court had been exceeded. However, it wasn’t given the proper attention to the problem of knowing if the interested person was really a member of the cooperative.
