LABOUR PARTNERSHIP: LABOUR CONTRACT MATTERS

The Law of Labour Partnerships is a law focused on Commercial Law. For that reason there are numerous questions about Labour Law. The labour contract itself of the working partners is subject to change by the influence of the partnership.
This study tries to reach an answer about unfair dismissal of temporary workers and termination of contract by constructive dismissals. There is also a debate about behaviours against the partnership which can be pursued by double channels: labour dismissal and partner punishment. It is also an important matter the restrictive character of the Labour Jurisdiction which only allows to file suits about the services paid by the worker. About Social Security regime, we must pay attention to all possible situations, especially for managing partners. The Law solves in a reasonable way the conflicts between the self-employed regime and workers’ regime.
