Abstract

The present work aims to analyse the judgment delivered in Case n. 0001924-29.2014.5.03.0134, by the Regional Labor Court of the 3 rd Circuit and published on September 28, 2016. According to the Brazilian labor court, the Labor Law is
not applicable to the relations between the cooperative and its associates.

Therefore, the approach of typical concepts of Labor Law and the position of this area of ??study in Brazilian legislation will be presented in order to highlight the distinctions between its characteristics and the inherent peculiarities, both doctrinal and legislative, of cooperativism. In addition, the conflicts resulting from the misunderstanding of these differences will be exposed, in order to point out the fifth cooperative principle as an essential guideline to reduce judicial disputes.
