Abstract

The commented judgment puts into evidence the problems caused by the succession of competences regarding communal land (baldios) administration, mostly when they are partially used for public and not communitarian purposes. We take the opportunity also to clarify institutional aspects regarding the “baldios” institute, their constitutional and legal regime and their nowadays importance.
